1. What Fourth & Data is — and is not

Fourth & Data is a sports data publication. Football — the NFL and college football — is what this site leads with, and the same subscription also covers MLB, the WNBA and the Premier League. We publish numbers: win probability with the vig removed, prices across sportsbooks, injury designations, weather and surface conditions, opening and current lines, and graded cards of what we published.

Where we describe our own publishing record, we are describing data we published, not returns you would have made.

2. Who may use it

To use Fourth & Data you must:

• be at least 21 years old;
• meet the legal wagering age wherever you are, if you intend to wager at all; and
• not be barred from our service or from wagering under the laws that apply to you, including any self-exclusion list you are on.

Sports wagering is regulated differently in every jurisdiction and is unlawful in some. Whether you may lawfully act on published data where you live is your responsibility to determine, not ours. Our data is published from the United States and is not an offer to provide gambling services anywhere.

If gambling is causing you harm, stop and get help. In the US, call or text 1-800-GAMBLER (1-800-426-2537) — free, confidential, 24 hours a day.

3. The 5-day free trial

New subscribers get 5 days of full access at no cost. We ask for an email address and nothing else.

If you want to keep going after the trial, you choose to subscribe. That is an active step you take, never something that happens by default.

The trial is one per person. We may decline or end a trial we believe is being reused across multiple addresses by the same person.

4. Subscription, billing and refunds

A subscription costs $9.99 per month in US dollars. If you subscribe:

• You are billed when you subscribe and then monthly on the same date, until you cancel.
• Payment is handled by [PAYMENT PROCESSOR]. We never see or store your full card details — the processor does, under its own terms.
• You can cancel at any time. Cancelling stops the next charge; access continues to the end of the period you have already paid for.
• Prices can change, but not without at least 30 days notice by email, and never mid-period. If you do not want the new price, cancel before it takes effect.

What the subscription covers

One subscription covers every sport we publish — the NFL and college football, plus MLB, the WNBA and the Premier League. There are no separate tiers, and no sport is held back for an extra fee.

Football is seasonal. Outside the NFL and college football seasons there are no football slates, and your subscription and billing continue across the other sports we cover. If you do not want that, cancel — you will not be charged again.

Refunds

Taxes, where they apply, are added to the price shown.

5. Your account

Keep your access credentials to yourself. You are responsible for what happens under your account, and for the accuracy of the email address you give us — it is how the card reaches you.

6. Acceptable use

You may use Fourth & Data for your own personal, non-commercial purposes. You may not:

• republish, resell, syndicate or redistribute our data or cards, in whole or in part, whether or not you charge for it;
• scrape, crawl or bulk-extract the site, or use automated tools to harvest the cards or the odds board;
• use our data to build or train a competing product, model or dataset;
• share your access with people who have not paid for it; or
• interfere with the operation or security of the site, or try to reach parts of it you have not been given access to.

7. Our content and your licence to it

The cards, odds boards, written material, branding and site design are ours (or our licensors’) and are protected by copyright and trade mark law. Underlying factual data — scores, prices, line movements — is not owned by anyone; our particular selection, calculation and presentation of it is.

League, team and sportsbook names are the trade marks of their owners. We use them to describe the games and prices we are reporting on. We are not affiliated with, endorsed by, or sponsored by the NFL, the NCAA, Major League Baseball, the WNBA, the Premier League, any conference, any school, any team, or any sportsbook.

While your subscription is active we grant you a personal, revocable, non-transferable licence to access and use the content for yourself. That licence ends when your access does.

8. Accuracy, timing and availability

We work hard to get the numbers right, and we still cannot promise they are correct or current. In particular:

• Lines move. A price we published in the morning may be gone by kickoff. Always verify the current number at your own sportsbook before wagering.
• Weather is a forecast, not a measurement.
• Injury designations change. Questionable becomes out, inactives drop shortly before kickoff, and a late scratch can move a number more than anything we published that morning.
• We depend on third-party data feeds, and we inherit their errors and outages.

We aim to publish on the morning of every game day but do not guarantee it, and we do not guarantee the site will be available without interruption. Missing a slate is not a breach of these terms.

9. Sportsbooks and other third parties

We name sportsbooks and link to third-party sites so you can check prices yourself. We do not operate them, control them, or vouch for them, and your dealings with them are entirely between you and them. Listing a book is not an endorsement of it.

10. Disclaimer of warranties

The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the data will be accurate, complete, timely, uninterrupted, or profitable to act on.

Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, neither we nor anyone working with us is liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost wagers, gambling losses, or lost data, arising out of your use of Fourth & Data — whether or not we were told such damages were possible.

Our total liability to you for any claim relating to the service is limited to the greater of the amount you actually paid us in the 12 months before the claim, or $50.

Nothing here limits liability that cannot lawfully be limited, including for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising from your use of the service, your breach of these terms, or your violation of any law or of anyone else’s rights.

13. Changes to the service and these terms

We may change what we publish, add or drop sports and leagues, and change how the service works. We may also update these terms; when we do, we change the “last updated” date at the top.

If a change materially reduces your rights and you are a paying subscriber, we will tell you by email at least 30 days before it takes effect. Continuing to use the service after a change takes effect means you accept it.

14. Suspension and termination

You can stop at any time — unsubscribe from the emails, or cancel a paid subscription.

We may suspend or end your access if you breach these terms, if we reasonably suspect fraud or abuse, or if we discontinue the service. If we end a paid subscription for a reason other than your breach, we refund the unused part of the period you paid for.

15. Governing law and disputes

These terms are governed by the laws of [STATE], without regard to its conflict-of-laws rules. You and we agree to bring any dispute exclusively in the state or federal courts located in [COUNTY, STATE], and both consent to the jurisdiction of those courts.

If you are a consumer, this does not take away the protection of mandatory consumer laws where you live, or your right to bring a claim in your local courts where the law gives you that right.

If any part of these terms is held unenforceable, the rest stays in force.
